The following agreement is between Rodolfo Maeda, hereafter referred to as “Breeder” or “Seller” and BUYER hereafter referred to as “purchaser” or “Buyer” for the sale and purchase of a purebred male/female Havanese pet quality puppy specified below:

The above described Dog is a pure bred Havanese with the litter registered with the American Kennel Club (AKC).
The price of $ 2,000.00 is to be paid immediately with a personal check, cashier’s check or cash upon the delivery of the above-mentioned Havanese hereinafter referred to as Puppy/Dog. A $500 deposit has been received from the buyer.
Meaning of Love’s will be used as the prefix to the Dog’s name on the AKC papers.
Health warranties/Information: Every effort has been made to produce healthy, sound puppies both by breeding only dogs (parents) have had required breed specific tests performed and the results made publicly available, and by raising the puppies in the best way possible with respect to diet, exercise, socialization and veterinary care. Further, the Breeder warrants that both the sire and dam’s hearing has been BAER tested and confirmed normal, and that their eyes have been examined by a veterinary ophthalmologist and certified by CERF to be free from inherited eye disorders. Copies of these certificates are available for viewing at www.offa.org .
1. The Breeder guarantees the Puppy to be healthy at the time of sale. The Buyer agrees to have the Puppy examined by a veterinarian within 72 hours of delivery. If the Puppy is found to be other than healthy by the Buyer’s veterinarian, it shall be returned to the Breeder within 5 days of such examination, and the purchase price will be refunded.
2. This refund policy does not cover death due to neglect or abuse. Refund is contingent upon Puppy being returned to Breeder in the same condition that it left Seller's property, and with a written explanation of diagnosis by the Buyer's veterinarian.
3. The Buyer also agrees that in the event of death in that 72 hours, the puppy is to be taken to a vet for an autopsy. If the death is proven to be due to a genetic illness or an illness contracted while in the Breeder’s care, the puppy will be replaced if possible or full refund of purchase price and the autopsy expense will be refunded.
4. If the dog dies of a genetic illness within 1 year of its birth date, the dog will be replaced by the breeder, if one is available. If there is not a puppy available, then the purchase price will be refunded. All above claims will only be honored with written documentation from a licensed veterinarian.
5. Seller shall not be held responsible for the development of non-genetically derived disqualifying faults, diseases, or disorders that are due to Buyer’s negligence or injury to the Dog.
Important Note:
1. I do NOT guarantee any health-related issues or loss of life due to reactions caused by vaccinations. I do NOT give leptospirosis to my puppies and don’t suggest the buyer does. I give shots spaced 4 weeks apart starting the first at 6 weeks of age. Havanese can be sensitive especially to Lepto and Lyme disease vaccines. Please follow my vaccine protocol for the health of your puppy and be aware that some topical flea medications can cause a reaction in some dogs.
2. No guarantees are issued or implied regarding “bite deterioration”. (overbite, underbite or wry!) This includes a dog being sold as a show/breeding potential.
3. All appropriate inoculations for the Puppy's age have been given, and a record of this medical treatment is supplied.
4. The Buyer agrees to maintain the Puppy's health in good condition, and to provide routine care of the Puppy, which must include immunizations, flea preventative, teeth care and any other usual procedures necessary to assure good health.
5. Seller and Buyer agree that there is no such thing as a “perfect” animal and things can develop or happen as the puppy grows. This doesn’t mean the breeder knowingly sold a puppy with a defect. Buyer agrees to inform Breeder if the Puppy ever develops any problems which Buyer’s veterinarian feels are of a hereditary nature, so that the Breeder can take steps to avoid further reproduction of such problems. Seller will either reimburse the selling price of the Dog to the Buyer or will offer a replacement puppy from the next available litter if a life threatening or crippling genetic defect should develop within the first year of the Dogs life once a veterinarian/specialist, agreed upon by both Seller and Buyer, has determined/diagnosed said defect.
Pet Puppy
1. The Buyer agrees to have the “Pet” Dog neutered or spayed. The dog should be neutered between 6 months of age and no later than 9 months of age, or spayed no earlier than 18 months of age, as this puppy is being purchased under a “limited” AKC registration and buyer further agrees to never allow this Dog to be used for breeding. Puppies sold on limited registration cannot be shown in AKC Conformation Shows or bred. Please provide proof of neutering/spaying of the above-named Dog from a licensed veterinarian once the dog has reached the appropriate age.
2. Breeder and Purchaser agree that the Puppy is being acquired as a family companion and will be treated accordingly. The Puppy may be used for tasks appropriate to its breed, such as therapy dog, or for exhibition obedience, or agility competition.
3. We agree that the Puppy is not purchased for resale or lease, nor will it be used or trained for activities for which it is not suited by reason of temperament or conformation, further agreeing that the Puppy will not be permitted to run unsupervised in a non-fenced area or kept as an "outside dog".
4. Buyer agrees Seller will REPOSSESS DOG UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the Seller. Neglect is defined as failure to attend or provide adequate care suitable for a family companion dog, inhumane, inattentive, or reckless regard for the animal. All health documentation and registration will be properly signed and returned to Seller.
5. The Buyer also agrees to provide a suitable fenced area for this Dog.
6. The Buyer agrees to socialize, train and keep the Dog in a manner acceptable for Havanese, a companion dog. Buyer further agrees this Dog will not be confined to a crate or left isolated in a small space and without human contact, for more than 4 hours unless during the night while Buyer is sleeping.
General
1. Seller shall not be held responsible for acts of the Puppy that are due to Buyers negligence
2. The Buyer agrees to notify the Breeder of any changes of address, phone, and email address during the Puppy's lifetime.
3. In the event that Buyer is unable to keep the Puppy in accordance with the terms of this agreement, at any time, the Puppy will be returned to the Breeder (or placed in a home consented to in writing by Breeder). Buyer agrees to notify the Breeder if any such contingency arises and will not abandon the Puppy to a shelter, rescue or sell, or give the Puppy away. This option does not guarantee that the Buyer will recover any or all, of the purchase price.
4. The Dog may not be transferred or sold by the Buyer without notification to seller.
5. The Seller will not pay for any veterinary or other costs of keeping the Dog incurred by the Buyer resulting from his/her ownership of the above-named Dog.
6. Buyer agrees that he/she is not acting as an agent in the purchase of this Dog and that Buyer will not sell this Dog to any agent, pet store or other animal business.
Disclaimer
1. Should Buyer choose to break any of the covenants of this agreement, the remainder of the agreement will be considered null and void, and Seller will have the right to repossess the Dog at no expense to the Seller. All health documentation and registration will be properly signed and returned to Seller.
2. Buyer and Seller have read, fully understand, and agree with all the terms and conditions of this contract. Any other agreements or amendments to this contract must be in writing and signed by all parties.
3. If there is any legal action between Seller and Buyer to enforce the terms of this Contract, the unsuccessful party to such action will pay to the prevailing party all costs and expenses, including reasonable attorneys’ fees.
4. There are no oral agreements between Seller and Buyer affecting this Contract.
5. If any provision of this Contract is determined to be illegal or unenforceable, such determination will not affect any other provisions of this Contract.
6. This Contract is to be governed by and construed in accordance with the laws of the State of Texas.
7. This Contract was entered in Montgomery County, Texas.
The undersigned agree to uphold all covenants to this agreement.
